Terms of Service

1. About the service

OpenHouseHQ, operated by LevelNex AI, is a lead-capture and follow-up tool for real estate agents. It provides branded open-house sign-in pages, QR codes, and text and email follow-up. By using the service in any capacity, you agree to these Terms. OpenHouseHQ is currently in beta.

2. Accounts

Accounts are intended for real estate agents and professionals. You must provide accurate information, keep your password secure, and you are responsible for all activity that occurs under your account.

3. Acceptable use and your responsibilities

You are responsible for how you collect and use the visitor information you gather through the service. You agree to:

  • Collect visitor information lawfully and use it only in the ways those visitors consented to.
  • Only send text messages to people who gave the required consent, and honor opt-out requests (STOP) promptly.
  • Comply with all applicable laws and regulations, including the Telephone Consumer Protection Act (TCPA) and other telemarketing and anti-spam rules, as well as carrier messaging requirements.
  • Not use the service for any unlawful, harassing, misleading, or deceptive purpose.
  • Not attempt to access another user's account or data, or reverse-engineer the service.

You, not LevelNex AI, are responsible for the messages you send and for your use of the lead data you collect.

4. Your leads and content

You own the listings and lead data you create and collect. By using the service, you grant LevelNex AI a limited license to store and process that content solely to operate the service for you. We act as a service provider handling this data on your behalf; you are responsible for having the right to collect and use it. We do not sell your data.

5. Text messaging

Program description. OpenHouseHQ sends text messages on behalf of the real estate agent whose open house you signed in at. Transactional messages confirm your sign-in and provide updates about that property, such as access links, price changes, received offers, and open-house schedule changes. If you also gave marketing consent, you may receive messages about other properties and services.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to opt out, after which you will receive no further messages. Reply HELP for help, or email info@openhousehq.app.

Carriers are not liable for delayed or undelivered messages.

Text messages are sent through Twilio. Agents are responsible for the content of any message they compose and for complying with messaging regulations and carrier requirements, including registration obligations such as A2P 10DLC where applicable.

6. Text-message alerts to agents

When you sign up you may agree to receive lead-alert text messages from OpenHouseHQ at the mobile number you provide. These alerts tell you that a visitor has signed in at your listing and include a link to text them back from your own phone. Message frequency varies and depends on your open-house activity. Message and data rates may apply. Reply STOP to any alert to stop receiving them, or HELP for help. Stopping alerts does not affect your account or your visitors' messages.

7. Texting on your behalf

If you ask OpenHouseHQ to register a texting number for you, you authorize LevelNex AI LLC to submit your business information to our messaging provider (Twilio) and the carriers' registry on your behalf, and you confirm that the information you provide is accurate and that you are authorized to act for your business. Automatic visitor texts from the app are sent only after that registration is approved, from a number dedicated to you. Until then, you can text visitors from your own phone using the links we provide. We cover the registration and number fees during the beta; we will tell you in advance before any fee is charged to you.

8. Beta and availability

OpenHouseHQ is currently in beta and provided free of charge. Features may change, and we may modify or discontinue parts of the service. If we introduce paid plans, we will provide notice before doing so.

9. Disclaimer of warranties

OpenHouseHQ is provided “as is” without warranties of any kind. We do not guarantee the service will be uninterrupted, error-free, or suitable for any particular purpose. OpenHouseHQ does not provide legal advice, and compliance with the TCPA and other applicable laws is your responsibility.

10. Limitation of liability

To the fullest extent permitted by law, LevelNex AI shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability for any claim shall not exceed the greater of the amount you paid us in the three months preceding the claim or fifty U.S. dollars.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of the service after changes are posted means you accept the updated Terms. We will provide reasonable notice of material changes.
